By creating an account or using AIVideoGist ("Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

We reserve the right to update these Terms at any time. Continued use after updates constitutes acceptance. Material changes will be notified by email.

AIVideoGist provides AI-powered audio and video transcription and summarization. We process media content using third-party AI APIs (Deepgram, DeepSeek) and return structured summaries including transcripts, timelines, takeaways, and mind maps.

• You must be at least 13 years old (16 in the EU) to use the Service.
• You must provide accurate registration information.
• You are responsible for maintaining the security of your account credentials.

You retain all rights to the audio/video content you submit for processing. By submitting content, you grant AIVideoGist a limited, non-exclusive license to process that content solely to provide the Service to you.

You represent and warrant that:

• You own or have sufficient rights to the content you submit.
• Your content does not infringe any third-party intellectual property rights.
• Your content does not violate any applicable law.

AI-generated summaries of YouTube videos processed through the Service may be published publicly at aivideogist.com/summary/{videoId} as transformative AI commentary. You may request removal via our DMCA process below.

• Credits: 1 credit = 1 minute of audio/video processed. Credits are consumed upon job submission and refunded in full if processing fails.
• Subscription Credits: Reset monthly on billing renewal. Unused subscription credits do not carry over.
• Purchased Credit Packs: Never expire and are non-refundable after use. Unused pack credits survive subscription changes.
• Free Plan: 20 credits per month, features limited to TXT export.
• Refunds: Subscription fees are non-refundable except where required by law. Unused credit packs are non-refundable. Failed jobs are always credited back automatically.
• Price Changes: We reserve the right to change pricing with 30 days notice for existing subscribers.

You may not use AIVideoGist to:

• Process content that violates copyright, defamation, privacy, or other applicable laws.
• Scrape, bulk-download, or systematically abuse the Service or API.
• Attempt to circumvent usage limits or access controls.
• Process content depicting illegal activity, CSAM, or content promoting violence or hate.
• Resell or white-label the Service without written permission.
• Reverse-engineer, decompile, or attempt to extract the source code of the Service.
• Use the Service for spam, phishing, or other malicious purposes.

Violation of these terms may result in immediate account suspension and credit forfeiture without refund.

Summaries, transcripts, timelines, and takeaways are generated by artificial intelligence and may contain errors, omissions, or inaccuracies. AIVideoGist makes no warranty regarding the accuracy, completeness, or fitness for any particular purpose of AI-generated output.

Do not rely on AI summaries as substitutes for professional advice (legal, medical, financial, etc.). Always verify critical information from the original source.

AIVideoGist respects intellectual property rights. If you believe content on our platform infringes your copyright, submit a DMCA notice to:

Your notice must include:

• Identification of the copyrighted work and the infringing content (URL).
• Your contact information and a statement of good faith belief.
• A statement under penalty of perjury that you are authorized to act on behalf of the copyright owner.
• Your physical or electronic signature.

We will remove confirmed infringing content promptly (typically within 48 hours) and set the associated public video page to return a 410 Gone response.

We do not guarantee 100% uptime. We may modify, suspend, or discontinue the Service at any time with reasonable notice. We are not liable for interruptions caused by third-party API providers (Deepgram, DeepSeek, Cloudflare).

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AIVIDEOGIST'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE LAST 3 MONTHS. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

These Terms are governed by applicable law. Any disputes shall be resolved through binding arbitration, except where prohibited by law. You waive the right to participate in class action lawsuits to the extent permitted by applicable law.
